Legal Disclaimer, Non-Reliance Statement, and Hold Harmless Agreement

1. Purpose and Scope

Security Screening IQ™ ("the Platform") is an analytical and benchmarking tool designed to assist security professionals in evaluating screening efficiency and throughput metrics. The Platform is provided by CSSM-USA ("Provider") for informational and analytical purposes only.

2. Non-Reliance Statement

THE PLATFORM IS NOT:

• A security program or security management system
• A training system or certification program
• A compliance verification or certification tool
• A guarantee of safety, security effectiveness, or threat prevention
• A substitute for professional security consulting, training, or operational guidance

Users acknowledge that the Platform provides metrics, scores, and recommendations based solely on user-provided data and standardized benchmarks. These outputs are intended to support—not replace—professional judgment, institutional policies, regulatory compliance, and comprehensive security programs.

3. Data Accuracy and User Responsibility

Users are solely responsible for the accuracy, completeness, and validity of all data entered into the Platform. The Provider does not independently verify user-submitted information. Outputs, including Efficiency Scores, Tier classifications, and recommendations, are directly dependent on the quality and accuracy of input data.

4. No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE PROVIDER SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE PROVIDER DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Use or inability to use the Platform
• Any security incidents, breaches, or failures at user facilities
• Unauthorized access to or alteration of user data
• Reliance on any metrics, scores, or recommendations provided by the Platform
• Any errors, omissions, or inaccuracies in Platform outputs

6. Hold Harmless and Indemnification

User agrees to defend, indemnify, and hold harmless the Provider, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• User's access to or use of the Platform
• User's violation of this Agreement
• User's violation of any third-party right, including privacy or intellectual property rights
• Any security incidents, regulatory actions, or third-party claims related to User's security operations, regardless of whether Platform data was utilized

7. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to this Agreement shall be instituted exclusively in the state or federal courts located in Hillsborough County, Florida, and each party irrevocably submits to the exclusive jurisdiction of such courts.

8. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Modification of Terms

Provider reserves the right to modify this Agreement at any time. Users will be required to re-acknowledge modified terms before continuing to use the Platform. Continued use of the Platform after modifications constitutes acceptance of the revised terms.
